High Court rules Lockdown Level 4 and 3 Regulations unconstitutional

A judgment in the High Court has declared the Regulations issued under Level 4 and Level 3 as unconstitutional and invalid. Click here, for the judgement.

The declaration of invalidity by the Court, is suspended pending the Minister re-publishing most of the regulations except for those mentioned in the judgement. The immediate effect of this is that any fines, criminal records and prosecutions under these regulations are likely to be invalid.

Please note that in the meantime, we advise our members to continue to implement the regulations where possible, as they are published currently and as amended in due course, should the amendments satisfy the Court.
